About the Course                           

This two days executive workshop is targeted to enhance the appreciation and understanding about framework of the Concession Agreements between decision makers and supporters from Port & Terminals and Concession granting authorities. The workshop aims to encompass entire spectrum of concession agreements – from identification of infrastructure development elements and private investment requirement to preparation of legal and financial framework in order to develop a transparent and bankable model concession agreement; defining the steps and process for inviting expression of interest to capturing concession agreement clauses which are attractive for project proponents, investors, financers and meeting the broader objectives and interests of the public, community and society.

Significance / relevance of the course

With a steady growth in world GDP and volume of international trade, substantial investment is required to enhance the cargo handling and hinterland connectivity with gateway ports. With ambitious plans for their ports and terminals; governments all over the world are increasingly encouraging and providing various incentives to investors and operators to build and expand Ports and Maritime infrastructure. Over a period of time, roles of the Government and public bodies have changed to remain landlord /owners of public assets – waterfront and port land. Private enterprises gradually increase their role in the ports by taking charge of financial and operational risks. In this process, Government and public bodies assume the roles of owners of land & waterfront and regulators of the port while private enterprises take on complete responsibility of Port operations. This course will attempt to provide an integrated approach to develop the main legal instrument – The Concession and implementation and execution of the Concession Agreement.

Deliverables:

At the end of this course, the participants will be able to:

  • Identify elements of Maritime Infrastructure and estimate investment required.
  • Understand Private sector investment for Maritime Infrastructure Development.
  • Develop a balanced Model Concession Agreement.
  • Analyze all conditions of The Concession from the perspective of the authorities, concessionaire, investors and financers.
  • Learn the elements of Detailed Project Report for a Terminal / Port Project
  • Prepare Hinterland Mapping for a Port Location
  • Work out Business Volume Forecast for Port with logical assumptions
  • Arrive at a basic financial model for financial viability of a Terminal / Port Concession.

A combination of Class room Training, Interactive workshops, Individual and group case studies will be used. Participants will be provided with advance study / reading material on each topic covered under deliverables.

World Trade and Terminals / Ports scenario: A global perspective of changing role of The Government and Public Ports from Service ports to landlord and asset owners.

Developing Model Concession Agreement: Class room training followed by a group case study for a real port and identification of Concession elements, clauses, terms and structure.

Understanding Financial and legal implications of a typical concession: class room training followed by a role play exercise.

Session 4

Concession Agreement Execution and implementation: Detailed project report, Financial viability of the concession Class room training and Group case study.

About the Course Director  

This program will be conducted by Mr. Mukesh Parikh who is associated with Global Maritime Industry for over 35 years. Mr. Mukesh Parikh has a distinction of having hands on Maritime Industry experience with continuous involvement in Training and Development throughout his distinguished career. Mr. Mukesh Parikh has a post graduate degree in Management with specialization in Marketing and Finance. He attended one year training program Professional Shipping at Norwegian Shipping Academy, Oslo.

During his career of 18 years in the Commercial Shipping, he was associated with UNCTAD/UNDP as a Trainer and Course developer. He attended two weeks instructors Workshop (Training for Trainers) organized by UNCTAD / UNDP in collaboration with The Ministry of Transport and Ports in Malaysia at Penang Port Commission. He conducted a number of training Programs in the Middle East, South East Asia and Indian subcontinent including developing a training program on General Shipping Management for Arab Maritime Transport Academy, Sharjah, UAE;  covering shipping subjects.

A sound foundation of Shipping Industry and clear understanding of market and customer requirement and expectations from service providers enabled Mr. Mukesh Parikh to build the next phase of his career in Ports and Terminal Industry. He joined The Adani Group in Senior Management position at the inception stage of Mundra Port in India and made a major contribution to set up Business Development and Marketing Team as well as Establish Standard Operating Procedures for the entire spectrum of Operations in the Port. He successfully built marketing and operations teams and trained them. His next role was Chief Operating Officer of Sterling Port for setting up integrated Port Facilities at Dahej Port. All stages of Green Field Port development were covered – From site selection to Feasibility, Environment Impact Assessment and Environment clearance for the project, Detailed Project Report, Concession Agreement with Authorities for development of Port infrastructure and facilities on Build, Own, Operate and Transfer model.

Since July 2014, Mr. Mukesh Parikh has taken up advisory and consultancy role for The Maritime Industry. His assignments for Ports and Terminals cover Business volume estimation and hinterland mapping with competition analysis, Revenue forecasts for the life of the project and financial modelling, investment optimization in line with market potential; Commercial and legal aspects of logistics, cargo handling, warehousing contracts; business excellence and standardization of operating procedures; Organization development, structuring and Manpower planning and training.

About the course

Today’s ports and terminals cannot run without technology as it cannot serve the customers effectively. With this in mind,  this 2-day course is aimed at providing a deep understanding of the subject matter. However, participants of this course need not be practitioners of IT or engineering as it covers the applications of technology and how it is used to improve efficiency in the port. It will commence with an analysis of current shipping trends that affects port development and operations. It will highlight the issues on terminal operations and delve into the various technologies that will uplift the productivity of the port and lead to more efficiency. Participants will understand in detail the various technologies and IT applications and how to apply them. They will also learn how to align technology to the business strategy, develop a technology masterplan, discuss the issues in implementation and strategies to implement a successful plan. Practical examples on applications in big and small ports will be given so that participants will have a better understanding. Throughout the sessions, real-life examples will be given on big and small ports and discussed in detail. This will include PSA, MPA, Portek International, Gabon, Algeria, Sri Lanka and a port in Hong Kong. Participants will participate in exercises and analysis and provide solutions to case studies presented.

About the Course Director

Yap Cheng Hua has 42 years of experience in the port and maritime industry. His entire career is centred mainly on ports and terminals where he has hands-on experience on port operations. His major core expertise is having deep knowledge of port processes and procedures and applying technology for improving port productivity.

In his earlier career, he was with the PSA for 22 years developing the computer systems which gave PSA the edge to excel as the most efficient transhipment container port in the world. He also wrote and implemented the IT Master Plan for PSA and led consultancies projects for ports in China in the 90s, just as China was starting out the present economic development. He also served as a board member of Crimson Logic and CIAS which provided services in the air industry and in direct competition with SATS. He also wrote a monograph for UNCTAD on “Steps to better transit Shed Management”.

Following the restructuring of the maritime industry in 1996, in which he was one of the founding directors, he became the Chief Information Officer of the Maritime & Port Authority of Singapore (MPA), and also its Chief Innovation Officer. As CIO, he managed the IT applications and infrastructure of the MPA and initiated integration with various community networks. He also chaired many corporate and national committees over the years and promoted IT development in the maritime industry. Being in senior management, he held leadership positions of national delegations to International Maritime Organisation (IMO) and Asean Ports Association. At IMO, he chaired the IT Facilitation Committee. His last appointment at MPA was Director (Corporate Services) and this includes responsibilities for HR, Corporate Communications, Legal and IT (CIO).

He later joined Portek International and became the CEO of the technology subsidiary, Portek IT and Automation Pte Ltd (PITA) and concurrently, Director (IT), of the group. As CEO, he markets technology solutions to ports worldwide and installed some of these solutions to Algeria, Gabon, Sri Lanka and Rwanda and PNG. He also delivered consultancy for ports in Hong Kong, Bandar Abbas, Sri Lanka, Gabon, Tunisia and Algeria and PNG.  His most recent appointment is Advisor for Portek International for port technology especially on Automated Guided Vehicles.

He graduated with a Bachelor of Science 1st class Honours in Marine Engineering from University of Surrey, UK, 1974 under the Colombo Plan Scholarship awarded by the Singapore Government and 5 years later was sent by PSA and obtained Master of Science in Shipping Management, Massachusetts Institute of Technology, 1981 under the PSA Scholarship. While at MIT he received specialised training on Port Design, Management and Development and Information Systems Management and Supply Chain management

He has also serve as a guest lecturer appointed by the Nanyang Technological University, School of Maritime Studies, in subjects such as Shipping and Port management and SCM and Port Management, Shipping Logistics. He has also delivered lectures in international conferences on applications of technologies in port operations in London, Amsterdam, Antwerp, Dubai, Hong Kong, Bangkok, China and at MIT itself.

He has also obtained many international IT awards over the years, notably the Artificial Intelligence Award from AAAI institute, US in 1993, for marine deployment system, Minister Innovation Awards, 2002 & 2003,and was in the Top 5 finalists of the Computerworld Smithsonian Achievement Awards (Transportation Category), 2001.

These Awards will coincide with the Global Ports Forum Dubai to be held on 21-22 February, 2018, and will be given out during The Global Ports Forum Awards 2018 Dinner, to be held in Grand Hyatt Dubai Al Ameera Ballroom UAE on 22 February 2018 evening.

Award winners will be finalised by a jury comprising of Global Ports Customers & Senior Port Experts from the Global Ports Council through a transparent well defined process and applying common criteria in each category of the awards.
In the meantime, we look forward and welcome nominations for the 2018 Global Ports Forum Awards by 22 July 2017 covering the following:

  1. Provide us details of your organization / concerned personnel who are competent to stake a claim to one or more awards among the above listed categories.
  2. Please send a brief note describing justification for your claim to the relevant award, based on these the jury will finalize the list of award winners.
  3. Short listed nominees will be announced well in advance and their presence is desirable at the 2018 Global Ports Awards Dinner event.

Guests can look forward to an evening for networking among senior professionals of Ports / Terminal and supporting industries in a relaxed environment along with enjoying the achievement awards.

Dress Code: Formal suits / National dress for Gentlemen, Gowns / Cocktail Dresses for Ladies.
